1. Introduction
These Terms and Conditions ("Terms") cover your use of WotoWoto.com and any associated services (the "Service"). By accessing or using the Service, you agree to these Terms. Check for updates regularly, as we may change them from time to time.
2. Eligibility
To use WotoWoto, you must:
- Be at least 18 years old.
- Have the legal capacity to enter into contracts.
- Not be located in a country subject to United Nations embargoes.
- Not be on any restricted or prohibited lists.
- Have no criminal record.
- Have a verified email address and contact information.
- Treat others with respect and without discrimination.
3. Registration and Account Security
- Account Creation: You must create an account with accurate information, including a verified email address and valid contact details.
- Security: Keep your login information secure. You are responsible for all actions taken with your account.
- Duplicate Profiles: Creating multiple profiles is not allowed. Duplicate profiles may result in removal from contests or account suspension.
4. Recruitment of Users
- Prohibition on Fake Users: Recruiting fake users is strictly prohibited and may result in account suspension or legal action.
- Recruiter Responsibility: If you recruit others to join WotoWoto, you are responsible for ensuring they verify and complete their account profiles accurately. Incomplete or unverified profiles from recruited users may impact your standing on the platform.
5. Privacy and User Consent
- Privacy and Consent: By using WotoWoto, you agree to our Privacy Policy, which outlines how we collect, use, and protect your personal information. You consent to having certain aspects of your profile (like profile photos, bio, and general interests) visible to other users, in accordance with our Privacy Policy.
6. User-Generated Content and Responsibility
- User-Generated Content: You are solely responsible for the content you post on WotoWoto, including profile information, photos, and messages. By posting content, you grant us a non-exclusive, royalty-free license to use, modify, display, and distribute your content as part of the Service.
- Content Standards: Content should be respectful and truthful. WotoWoto reserves the right to review, edit, or remove content that violates these Terms, is inappropriate, misleading, or offensive, or does not adhere to community guidelines.
7. Prohibited Activities
To keep WotoWoto safe, we do not allow:
- Discrimination: Any discriminatory behavior based on race, gender, religion, disability, nationality, or other protected characteristics.
- Harassment and Bullying: Sending threats or abusive content.
- Impersonation: Misrepresenting your identity or affiliations.
- Child Exploitation: Any activity involving minors.
- Spam and Abnormal Usage: Sending unsolicited messages or engaging in unusual activity may result in account suspension.
- Intellectual Property Violations: Sharing copyrighted material without permission.
- Unauthorized Data Collection: Using bots or scrapers to collect data from WotoWoto.
- Service Disruption: Introducing viruses, malware, or taking any action to interfere with the Service.
- Commercial Solicitation: Unauthorized advertising or promoting businesses.
Consequences: We may suspend or terminate accounts that violate these rules and cooperate with law enforcement if necessary. Fake accounts are removed from contests and may be permanently blocked from WotoWoto.
8. Code of Conduct
We expect you to:
- Provide accurate information.
- Be respectful and follow all laws.
- Not harm or harass others.
- Use WotoWoto's content and features responsibly.
9. Premium Features and Billing
- Subscription and Billing: Certain features on WotoWoto are available only to paid subscribers ("Premium Features"). By subscribing, you agree to pay the fees associated with your chosen plan, including any applicable taxes.
- Auto-Renewal: Subscriptions renew automatically at the end of each billing cycle unless you cancel. You can manage your subscription settings in your account.
- Refund Policy: We do not offer refunds for unused portions of subscriptions, except as required by applicable law or as outlined in our Refund Policy.
10. Profile Verification
- Verification of Identity: WotoWoto may offer profile verification features to improve safety, requiring certain information or documentation. Verification does not guarantee the accuracy or authenticity of a user's identity. You agree not to falsify or misrepresent your identity, even in verified profiles.
11. Communication Policy
- In-app Communications Only: For privacy and safety, we encourage users to communicate through WotoWoto's messaging features. Sharing personal contact information (email, phone number, social media links) publicly or too early in conversations may increase risk and should be done with caution.

We collect information to improve our Service. See our Privacy Policy for details.
13. Disclaimers and Limitations
- “As Is” Service: We provide the Service "as-is" without guarantees about accuracy or error-free performance.
- User Responsibility: Use WotoWoto at your own risk. We are not responsible for losses from your actions on the site.
- Limited Liability: Our total liability is limited as permitted by law.
14. Safety Guidelines
While we prioritize safety, please use caution when interacting with others online and meeting in person. We strongly recommend reviewing our safety tips available on our site.
15. Reporting and Moderation
- Reporting Inappropriate Content: Users can report content or profiles they find inappropriate, unsafe, or in violation of these Terms. WotoWoto reserves the right to review reports and take necessary actions, including warning, suspending, or terminating accounts as needed.
16. Changes and Interruptions
We may modify, suspend, or discontinue the Service at any time, and we are not responsible for any impacts on your use.
17. Intellectual Property
All content, trademarks, and other intellectual property on WotoWoto are protected. You cannot use them without our permission.
18. Indemnity
You agree to cover our legal costs and damages if you misuse WotoWoto or violate these Terms.
19. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of the Republic of Kenya.
- Dispute Resolution: Disputes will first be addressed through good-faith negotiation. If unresolved, they will be settled by arbitration in Nairobi, Kenya.
20A. In-App Currency: Coins

WotoWoto operates an in-app credit system called Coins. The following terms apply to Coins:
- What Coins Are: Coins are a prepaid in-app credit that you purchase with real money (via M-Pesa, card, or other supported payment methods) and spend within the WotoWoto platform. Coins are a means of payment for in-app features and interactions only.
- How Coins Are Spent: You spend Coins on in-app actions such as sending virtual gifts to other users, accessing premium features, or engaging with content. When you send a gift to another user, your Coins are deducted and the recipient earns Diamonds (see Section 20B). Money does not buy Diamonds directly — Diamonds can only be earned, not purchased.
- Coins Are Not Cash: Coins have no cash value and cannot be withdrawn, transferred to another user, sold, or exchanged for anything outside the platform. Unused Coins are non-refundable except as required by applicable law or our Refund Policy.
- No Transfer: Coins are personal to your account and cannot be transferred to any other user or account.
20B. In-App Earnings Credit: Diamonds

WotoWoto operates an earnings credit system called Diamonds. The following terms apply to Diamonds:
- What Diamonds Are: Diamonds are a non-transferable earnings credit that you earn as a creator on the platform. They represent rewards for platform activity and are accumulated in your account balance. Diamonds are distinct from Coins. You cannot purchase Diamonds with money.
- How Diamonds Are Earned: Diamonds are credited to your account when other users send you virtual gifts (funded by their Coins), when you receive live rewards during live streams, when you complete eligible offers, or through other creator reward mechanisms operated by the platform.
- How Diamonds May Be Redeemed: Diamonds are redeemable exclusively through the in-app withdrawal system operated by Sirience LTD. You may request a payout of your accumulated Diamonds via the supported withdrawal methods (currently M-Pesa for KES payouts and PayPal for USD payouts), subject to the eligibility, limits, and fee terms set out in Section 20C and these Terms.
- Diamonds Cannot Be: Bought with money; traded, gifted, or transferred between users as Diamonds; sold or exchanged outside the platform; or converted into Coins or any other form other than a withdrawal payout through the platform's withdrawal system.
- No Guarantee of Value: The exchange rate between Diamonds and cash is set by the platform and may change. The platform does not guarantee a fixed cash value for Diamonds at any time.
- Expiry and Forfeiture: The platform reserves the right to set expiry terms for accumulated Diamonds or to forfeit Diamond balances associated with accounts that are terminated for violations of these Terms.
20C. Withdrawals, Fees, and Tax (M-Pesa and PayPal)

The following terms govern the withdrawal of Diamond earnings:
- Eligibility: To make an M-Pesa withdrawal, you must have completed identity verification (KYC) and provided a valid Kenya Revenue Authority (KRA) PIN. A valid KRA PIN is required for all M-Pesa payouts; withdrawals will be rejected if a valid KRA PIN is not on file.
- Minimum Withdrawal: There is a minimum Diamond balance required to initiate a withdrawal. The current minimum is displayed in the app at the time of your withdrawal request.
- Withdrawal Limits: Withdrawals are subject to per-transaction and daily limits as set by the platform and displayed in the app. The current defaults are a maximum of 3 withdrawals per rolling 24-hour period, a maximum of KES 150,000 per single M-Pesa transaction, and a maximum cumulative M-Pesa withdrawal of KES 500,000 per 24-hour period. These limits may change.
- Platform Fee: A platform service fee of 10% of the gross withdrawal amount is deducted from each payout (both M-Pesa and PayPal).
- Withholding Tax (M-Pesa / KES payouts only): M-Pesa withdrawals are subject to Withholding Tax (WHT) at the rate of 5% of the gross withdrawal amount, deducted at source, as required under Kenyan tax law. The platform operates as a withholding agent and remits WHT to the Kenya Revenue Authority (KRA) on your behalf. A WHT certificate will be issued for each completed M-Pesa withdrawal. PayPal (USD) withdrawals are not subject to Kenyan WHT.
- Your Tax Obligations: The platform's deduction of WHT does not satisfy all of your personal tax obligations. You remain solely responsible for declaring your earnings and paying any additional taxes that may be due under applicable law, including income tax. You should consult a qualified tax advisor regarding your individual obligations.
- KRA Reporting: The platform reports payout data to the KRA as required of a withholding agent. By requesting an M-Pesa withdrawal, you consent to this reporting.
- Net Payout: The amount credited to your M-Pesa account is the gross Diamond value minus WHT (5%) minus the platform fee (10%). Example: a gross payout of KES 1,000 results in WHT of KES 50, a platform fee of KES 100, and a net M-Pesa credit of KES 850.
20D. Regulatory Positioning: Diamonds, Coins, and Virtual Assets

- Diamonds Are Not Virtual Assets: Diamonds are an internal, platform-specific loyalty and earnings credit. They cannot be bought, sold, traded, or transferred between users. They are redeemable only through a single, platform-controlled withdrawal system. The platform takes the position that Diamonds do not constitute a "virtual asset" as defined under the Virtual Asset Service Providers Act (VASP Act) of Kenya or similar regulations. FLAG: This legal positioning MUST be confirmed by a qualified Kenyan lawyer before publication.
- Coins Are Not Virtual Assets: Coins are a prepaid in-app service credit used exclusively for purchasing in-app features. They have no cash-out mechanism, cannot be traded between users, and are not redeemable for cash. The platform takes the position that Coins do not constitute a virtual asset under applicable law. FLAG: This legal positioning MUST be confirmed by a qualified Kenyan lawyer before publication.
- Platform Is Not a VASP: The platform does not operate as a Virtual Asset Service Provider (VASP) and does not facilitate the exchange, transfer, or custody of virtual assets as defined under the VASP Act. FLAG: This determination MUST be confirmed by a qualified Kenyan lawyer before publication.
- FLAG — Legal Entity Details: The legal entity operating this platform is currently identified as Sirience LTD (Nairobi, Kenya) in these Terms. The exact registered legal entity name, registration number, and registered address MUST be confirmed and included here before this page is published. Using an incorrect or placeholder entity name in legal terms creates regulatory and enforceability risk.
20. Definitions
- Company: Sirience LTD (Nairobi, Kenya), the operator of WotoWoto.com, with technical support by Goatmentor Technologies AS (Norway).
- Content: Any text, images, videos, or other materials shared on WotoWoto.
- GDPR: The European Union's General Data Protection Regulation.
- Premium Features: Paid features available with a subscription.
- Refund: A subscription reimbursement as per our Refund Policy.
- Service: The WotoWoto website and all related services.
- Subscription: A paid membership granting access to Premium Features.
- User: Anyone registered with an account on WotoWoto.
- Coins: Purchasable in-app credit used to spend on platform features. See Section 20A.
- Diamonds: Non-transferable earnings credits accumulated by creators through platform activity. See Section 20B.
